Prices, Reservations & Payment
Italy by Vintage Car LLC (hereunder called IVC) guarantees that published trip prices will not change. We charge a single supplement to individual travelers who wish to ensure that they have private hotel rooms and/or car throughout a trip. Our prices are in U.S. dollars.

To reserve your trip we require a deposit of US $500 per person. The balance of your payment is due 100 days prior to departure. To finalize your reservation, you must complete, sign and return a Reservation Form that includes the Terms, Conditions. Acknowledgement of Risk, Release and Indemnity.

Canceling/Switching Trips
Should you need to cancel your reservation, the cancellation fees are as follows:

More than 100 days prior to your original departure date, you may transfer to a different trip in the same calendar year. Within 120 days of departure no changes can be made and the cancellation fees will apply.

Cancellation Insurance
We strongly recommend you purchase a Travel cancellation insurance that will cover your costs in the event that you need to cancel your trip.

Cancellation by Italy by Vintage Car LLC
Italy by Vintage Car reserves the right to cancel any trip due to unforeseen events and/or causes that make the trip unfeasible to operate. In such a case, a full refund of land cost is given but IVC is not responsible for additional expenses incurred by members preparing for the trip.
IVC reserves the right to cancel any trip at any time if the safety of travelers is judged to be compromised. Should this happen, refund of payments received by IVC shall constitute full settlement.
IVC cannot assume responsibility for any loss incurred on account of non-refundable air tickets

Eligibility
We require that travellers be at least 25 years of age on all trips except for "With the Kids" trips, which are designated for children aged 6 or older.

Preparing for your trip
Our trips entail risks - and rewards - beyond those encountered at home. We always stress that our trips are a partnership with travellers and our primary objective is to take the hassle out of a great travel experience. In return, we count on people to ensure they are healthy and fit to undertake the journey.

Travel Documents and Passport
The Visa and Passport requirements for entering Italy vary according to your nationality and may change for reasons beyond our control. North Americans may enter Italy and any of the countries in the EU with a passport valid at least 6 months and may stay for maximum 3 months without requiring a Visa. Although we endeavour to provide you with accurate information about the requirements, it remains the responsibility of each traveller to verify that they have the appropriate travel documents. IVC cannot be liable for any expenses or costs arising from a traveler being prohibited from entering Italy or the European Union.

External Travel Services
IVC may recommend the services of external travel agencies or other support services in response to requests made by travelers for services outside of the scope of the IVC trip. Although we make every effort to recommend only companies that provide the highest levels of service and work closely with them to try and obtain special treatment for IVC travellers, we cannot guarantee the services provided by these third party service providers. Italy by Vintage Car LLC cannot be liable for any expenses or costs arising from any services, or lack thereof, provided by any external travel service company.

Health
By sending a deposit toward your trip purchase and returning your Reservation Form, you certify that you do not have any physical condition or disability that would create a hazard for you or other travelers and you have received all appropriate vaccinations. Please consult your doctor.

Insurance
Before beginning on a trip, IVC strongly recommends that you review your personal and health insurance to ensure you have coverage appropriate to meet your needs and the needs of your family and dependants in case of any loss of property, or accident, injury or death.

Risks
All IVC trips are intentionally designed to take clients to the famous and the less know parts of Italy, where facilities, infrastructure, safety and other standards may be different from those in a traveler's home country. Trips involve driving and the risk of serious personal injury, including permanent disability and death from accident, illness or the actions or negligence of other persons. Medical facilities and services may not be easily accessible and may not be sophisticated. There are other risks associated with the trips, such as theft or loss of or damage to property. Some of the services provided in connection with the trip, including lodging, transportation, food service, and local tours and activities, are obtained from independent suppliers over whom IVC has no control

Release of Liability, Assumption of All Risks, and Arbitration Agreement

Italy by Vintage Car LLC., (hereunder called IVC) ) its employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents, representatives, and assigns (collectively Vintage Car Tour) does not own or operate any entity which provides, or is to provide, goods or services for your trip including, for example, lodging facilities, transportation companies, food service providers, equipment suppliers, babysitters or daycare providers, etc. As a result, IVC is not liable for any negligent or wilful act or failure to act of any such third person, or of any other third party.

In addition, I acknowledge that I have voluntarily applied to participate in the trip designated on this application and/or a trip to which I may subsequently transfer, and pre and post tour reservations. I am voluntarily participating in this trip with the knowledge of the risks and dangers involved including but not limited to: negligence in any manner on the part of including, without limitation, negligence in the conduct or arrangement of the trip in any respect from inception to completion, negligence with regard to the maintenance or operation of any car or other motor vehicle utilized to transport passengers, etc.; physical exertion for which I am not prepared; forces of nature; transportation failures whether by plane, train, auto, boat, by foot, or by any other conveyance; consumption of alcoholic beverages; risks associated with food or impure water; civil unrest; terrorism or the threat thereof; criminal activity; dangers associated with wild or other animals; breakdown or failure of cars or other equipment; high altitude; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; the adequacy of medical attention once provided; epidemics or the threat thereof; and stolen, lost, or misplaced luggage or property. I acknowledge that the enjoyment and excitement of adventure travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work and that these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I HEREBY AGREE TO BE RESPONSIBLE FOR MY OWN WELFARE AND ACCEPT ANY AND ALL RISKS OF DELAY, UNANTICIPATED EVENTS, INCONVENIENCE, ILLNESS, INJURY, EMOTIONAL TRAUMA OR DEATH.

I acknowledge that the cost of all IVC trips is based upon trip participants executing this Release of Liability, Assumption of All Risk, and Arbitration Agreement. Therefore, as lawful consideration for being permitted to participate on such trip(s), I hereby RELEASE AND DISCHARGE FOREVER ITALY BY VINTAGE CAR LLC FROM AND AGAINST ANY AND ALL LIABILITY ARISING FROM MY PARTICIPATION IN THE TRIP. I agree that this release shall be legally binding upon me personally, all members of my family and all minors traveling with me, my and their heirs, successors, assigns, and legal representatives, it being my intention fully to assume all the risks associated with this trip and to release IVC from any and all liabilities to the maximum extent permitted by law.

BINDING ARBITRATION: I agree that any dispute concerning, relating, or referring to this contract, brochures, or any other literature concerning my trip, or the trip itself shall be resolved exclusively by binding arbitration according to the then existing commercial rules of the American Arbitration Association in Boston, Massachusetts. Such proceedings will be governed by substantive (but not procedural) Massachusetts law excluding any application or consideration of the Massachusetts Arbitration Act. In all trips, the Italian Vehicle Code is applicable

MISCELLANEOUS MATTERS: I understand that IVC reserves the right to take photographic or film records of any of its trips and hereby agree that IVC may use any such photographic or film records for promotional and/or commercial purposes, as well as approve such use by third parties with whom IVC may engage in joint marketing, without any remuneration to me. I hereby assign all right, title, and interest I may have in or to any and all media in which my name or likeness might be used by Vintage Car Tour.
I understand that IVC reserves the right to refuse as a trip participant, or remove from a trip, any person it judges to be incapable of meeting the rigors and requirements of participating in the activities, or who it determines to detract from the enjoyment of the trip by others. I agree to follow all written and verbal rules of safety presented to me by Vintage Car Tour.
IVC reserves the right to make route, hotel, itinerary and trip modifications as required or desirable to improve the trip quality and/or to accommodate the comfort and well-being of guests.

KNOWING AND VOLUNTARY EXECUTION: I have carefully read and fully understand the contents and legal ramifications of this Agreement as well as all the conditions as stated in the present document, including but not limited to, those regarding cancellation and refund policies as stated above.
Exceptions to this policy cannot be made for any reason, including, but not limited to, weather, terrorism, civil unrest, personal, family or medical emergencies.
I understand that this is a legally binding and enforceable contract and sign it of my own free will.
I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
